Terms of Service
These terms and conditions of sale (hereinafter, the “Conditions of Sale”) apply to purchases made on the perinelli jewelry page (https://www.perinelligioielli.com), subject to the exceptions and modifications indicated below. These Conditions of Sale and the related documentation comply with the applicable provisions of Legislative Decree 206/2005 ("Consumer Code").
1. Notes on these Conditions of Sale
These Conditions of Sale apply to all orders and purchases made on the Perinelli Gioielli website. As regards purchases, Perinelli Gioielli will send its communications electronically via email or electronic communication. By using this online channel, users acknowledge that all declarations of intent, offers, communications, disclosures and other notices will be issued or provided electronically, except in cases where the law requires them to be in written form. These Conditions of Sale may be varied from time to time by Perinelli Gioielli, subject to the specification relating to the new starting date of their validity on the Perinelli Gioielli website. Any changes to the Conditions of Sale will apply to orders placed starting from the effective date (inclusive), provided that the Conditions of Sale, as modified, are visible on the site as conditions applicable at that time. Before placing an order for products, users will be given the opportunity to read these Conditions of Sale and will be asked to accept them.
2. Purchase via personal account
In order to place an order on perinelli jewels, the user creates a user account (username and password). You are required to maintain the confidentiality of your password and limit access to your account, and you assume responsibility for every act performed, and every purchase made, through your account. p>
3. Placing the order
To purchase products on Perinelli Gioiellli, you must:
• have accepted these Conditions of Sale and have read the privacy policy of perinelli Gioielli.
• provide your name and address, telephone number, email address, payment details and other requested information;
• provide a valid delivery address (please note that perinelli jewelery does not deliver to post office boxes or to automatic parcel distribution points. Orders are sent via courier and the signature of a natural person will therefore be required upon delivery);
< /span>• if paying by debit/credit card, be the owner or authorized holder of a valid debit/credit card to purchase the products; and
• in case of payments made via PayPal, be the holder of a valid PayPal account for the purchase of products.
The user can place an order by proceeding to checkout after clicking on the "ADD TO CART" button. You agree that your order(s) is/are an offer to purchase the product(s) indicated in your order pursuant to these Conditions of Sale. Each product order is considered a separate purchase. All orders are then subject to acceptance by Perinelli Gioielli, which reserves the right to refuse, without having to provide any explanation, any order (including, by way of example but not limited to, orders for which there is suspicion of fraud). The user will be notified if Perinelli Gioielli decides not to accept the order. The user will have the opportunity to review their order(s), read and accept the Conditions of Sale, check the total price and characteristics of the order(s) and the information provided, and to correct any errors entry before confirming the order(s).
4. Jewelry engraving service
When purchasing on the Perinelli Gioielli website, the user can request that the jewels under the order be engraved, at the additional cost agreed in advance with Perinelli Gioielli during the order phase, with numbers , letters, initials, words and short sentences, compatible with the size of the jewel. The available characters are exclusively those belonging to the Latin alphabet. Perinelli jewels reserves the right to refuse requests for jewelry engraving that are judged, in its sole discretion, to be in conflict with the law, in violation of the rights of third parties, offensive, vulgar or otherwise detrimental to the image of the products and/or the brand perinelli jewel or lovelook jewels. The user undertakes in any case to indemnify and hold harmless Perinelli Gioielli from any liability and damage deriving from requests for engraving of jewelery suitable to integrate the above. As specified below, users do not have the right of withdrawal, exchange and refund in relation to purchases of jewelery engraved upon their request, except for the application of the legal guarantee for defects in conformity of the products. p>
5. Order fulfillment and contract formation
Once the order(s) has been finalized on the Perinelli Gioielli website based on the instructions made available on the site through the procedure for placing online orders, Perinelli Gioielli will send an email to the email address provided, confirming receipt of the order(s) and indicating the details of the product(s) ordered (hereinafter, the "Order Receipt Confirmation Email") . The aforementioned email does not constitute acceptance of the order/s: it is only a confirmation of receipt of the order/s by perinelli jewels. The contract between the user and Perinelli Gioielli it will be considered concluded only when perinelli Gioielli sends the user an email to confirm that the product(s) has/have been shipped (hereinafter, the "Shipping Confirmation Email"). Perinelli jewels will send an email with the Conditions of Sale applicable for each purchase together with the Order Receipt Confirmation Email, for the user's future reference. 6. Prices, taxes and duties, shipping and handling
The price charged for a product will be the price indicated on the information/presentation page relating to the individual product at the time the user places the order, and will be indicated on the page confirmation that will appear to the user on the screen after finalizing the order and in the Order Receipt Confirmation Email. Product prices include VAT or other applicable taxes or duties, but do not include shipping and handling charges. Shipping and handling costs will be indicated separately on a summary screen before finalizing the order, as well as in the Order Receipt Confirmation Email. Shipping and handling costs are determined based on the location and delivery method selected during checkout.
7. Payment
Payments must be made using one of the methods indicated below, and chosen during the checkout procedure. The types of credit and debit cards accepted are also indicated in the footer of the Perinelli Gioielli website. In the event that Perinelli Gioielli does not receive authorization, Perinelli Gioielli reserves the right to cancel the order placed by the user. The value of the purchase(s) will be charged to the respective card once Perinelli Gioielli has sent the Shipping Confirmation Email to the user. In the case of payment with Paypal, the value of the purchase(s) will be charged at checkout.
Payment in installments with Paypal Pay in 3 installments
If you pay for the products purchased on perinelli jewellery using Paypal, you can also choose to divide the amount for purchases greater than or equal to €30 into 3 interest-free monthly installments via the "Pay in 3 installments" option, which can be selected directly from the Paypal site or app. The first installment will be charged at the time of purchase, the further 2 installments will be charged respectively 30 and 60 days after payment of the first instalment. 8. Delivery
Shipping times are 4-7 working days for standard delivery and 1-4 working days for delivery via express courier for available items, as long as payment is received before h . 12:00 on the day the order is placed. The times for the creation or creation of personalized jewelery are different from those described above and are communicated by Perinelli Gioielli when defining the order and may vary based on the type of work to be carried out. In any case, Perinelli Gioielli however, undertakes to ensure that, except in cases of force majeure, delivery occurs within 45 days of the user receiving the Shipping Confirmation Email. Deliveries are made only on Italian territory. In specific cases of objective impossibility or particular difficulty due to contingent situations, even upon notification from the relevant courier, Perinelli jewelery reserves the right to not deliver the order (for example, during the periods of the COVID-19 emergency, in territories considered “red zones” by the relevant courier). To this end, Perinelli Gioielli receives updates from the relevant courier whenever there are new territories in which it does not have the possibility of delivery. Perinelli Gioielli reserves the right to replace the courier responsible for delivering the order. If shipping via Express Courier is required, we invite the user to select the same as the delivery method. Each delivery will be preceded by the relevant purchase receipt, sent by Perinelli jewels via email. In the event that the user, without reasonable reason, postpones the delivery, or delays the receipt of the delivery after Perinelli Gioielli's notice that it has attempted to deliver the ordered items to the user, or in the event that the user has provided an incorrect delivery address which resulted in delivery failure, the package will be returned to Perinelli jewels, and Perinelli jewels will be released from the obligation to deliver the items within the established delivery deadline. Orders are processed via GLS or BARTOLINI courier: both couriers will require a signature upon delivery. If no one is available to sign on delivery, the courier will deposit the package at a collection point and will send an email to the customer who will decide whether to collect the package independently at the collection point or whether to reschedule the delivery to their home ( up to a maximum of 2 attempts). We remind you that the order will remain available at the collection point for 2 days. PERINELLI GIOIELLI will not be responsible for the delay or failure to deliver, if the delay or failure to deliver is caused by circumstances beyond its control including, by way of example but not limited to, acts of war or terrorism, strikes, states of emergency at national or local, failure of transport infrastructure, interruptions in the supply of electricity or other utilities, earthquakes, other natural disasters, postponements or delays in delivery caused by the recipient.
9. Product availability
If the product that the user intends to order is no longer available, the user will be technically prevented from placing the order on Perinelli Gioielli. Furthermore, in a few exceptional and unpredictable cases, a product indicated on the site as available may no longer be available after placing the order; in this case, the contract between the user and Perinelli Gioielli will not be concluded and the user will be notified accordingly; the product, therefore, will not be included in the Shipping Confirmation Email that will be sent to the user. In the event that payment is made before confirming the unavailability of the Product (e.g. via PayPal), Perinelli jewels will reimburse the sums paid by the user as soon as possible and in any case within thirty days of communication from Perinelli Gioielli of the unavailability of the Product
10. Compatibility, product information
The user is asked to verify, when ordering, that the products purchased are compatible with the use for which the user intends to allocate them. We invite the user to use the Perinelli Gioielli website. as the ultimate point of reference when checking compatibility. In the event of a discrepancy between the contents of the Perinelli Gioielli website and any other site (or any other source of information), the compatibility of the products as indicated on the Perinelli Gioielli website will prevail for jewels made and manufactured by Perinelli Gioielli at the time of purchase. Please note that due to limitations in the reproduction of product images on screen, the exact colour, size and design of the products on screen may differ from the actual characteristics of the products. Without prejudice to the above, if the products that the user has received do not correspond to those ordered, or if the delivery is incomplete or there has been damage in transport, we invite the user, to receive assistance, to immediately contact the span>Customer support of perinelli jewels within the legal deadlines as indicated in the following paragraph 12.
11. Product properties
The ownership of the products, and the related risk, are transferred from Perinelli Gioielli to the user upon receipt of the products by the latter.
12. Withdrawal, exchange and refund
Right of withdrawal. The user has 14 (fourteen) calendar days to withdraw from the contract with Perinelli Gioielli in relation to the item(s) purchased on the Perinelli Gioielli website.We will accept the return of any item purchased on our website provided that:
- has not been personalized upon your request;
– has not been altered or damaged in any way;

– the online order receipt is included;
– it is returned within 14 days from receipt of the order.

We will provide a full refund or free replacement once received the damaged goods.
The online order receipt and the products you wish to return must preferably be placed inside the box in which the order originally arrived. If this procedure is not carried out correctly, the Customer Service Center may take longer to identify the user's order and proceed with the refund, subject in any case to the timescales indicated below. Once the package has been prepared for return, the period of 14 (fourteen) calendar days starts from the moment of receipt of the item purchased on Perinelli jewelery or, in the case of a contract for the delivery of more than one item, from the moment of receipt of the last article of this contract. In order to respect the 14 (fourteen) day deadline, the date on which the withdrawal declaration is sent by the user will prevail. 13. Guarantees and legal rights
The user will be covered by a legal guarantee for the items purchased that prove defective both of the brands marketed by perinelli jewels and of the products created and manufactured by perinelli jewels. In such cases, the user may
• request the repair or replacement of the product (at his discretion, unless such remedies are excessively burdensome or impossible for Perinelli jewels );
• if both of the aforementioned primary remedies are excessively burdensome or impossible for Perinelli Gioielli, the user can ask to terminate the contract (with refund of the price of purchase by Paerinelli jewels, upon return of the products by the user) or reduction of the purchase price; or
• request compensation.
The purchased item is free from significant defects if , at the time of delivery, presents the agreed quality. To the extent that no specific quality has been agreed between the parties, the purchased item is considered free from significant defects if:
1. it is suitable for the use for which it is intended pursuant to the contract; and/or
2. it is suitable for the normal use for which it is intended and its quality is that normally found in articles of the same type, and the buyer can expect such quality given the type of article.
The term “quality” includes those characteristics that the buyer can expect based on the declarations on the specific characteristics of the purchased item publicly made by the seller, the manufacturer or his representative (by way of example but not limited to: on the material advertising or identification), except in the case in which the seller was not aware of the declaration and was not even required to be aware of it, or except in the case in which, at the time of stipulation of the contract, the quality was modified but was found to be always at the same level, or was not relevant to the decision to purchase the item. Perinelli Gioielli will bear all expenses necessary to remedy the defect; in particular: transport costs, labor and materials. Perinelli Gioielli may refuse to proceed with the type of remedy chosen by the user, if this type of remedy is only possible in the face of a disproportionate expense. In this context, account must be taken, in particular, by way of example but not limited to, the value of the item free from defects, the extent of the defect and the possibility of resorting to alternative remedies without causing substantial damage to the user. In this case, the dispute will be restricted to the alternative remedy; and the right of Perinelli jewels will also remain to refuse the alternative type of remedy, without prejudice to the requirements referred to in point 1 above. If Perinelli Gioielli provides, for the purpose of remedying a user's request relating to a defective product, a product free from defects, Perinelli Gioielli itself may request the return of the defective product. The user has the right to contest the defect of the purchased product only if he reports the defect to Perinelli Gioielli immediately after detecting it, or immediately after he should reasonably have detected it. Reports of defects made within 14 days of their discovery are considered timely. The legal guarantee, relating to the non-conformity of a purchased product with what was agreed in the contract, expires two years from purchase, without prejudice to the user's right to request a price reduction or compensation for damages, by way of exception in the context of legal actions aimed at obtaining payment of the price of the items purchased. Users are required to keep the order confirmation/invoice (and send it to the possible recipient of a product as a gift) as the original proof of purchase of the product which must be attached in order to activate the legal guarantee. Therefore, perinelli jewels will not be responsible for defects caused by such use and damage to Perinelli Gioielli products or brands marketed by Perinelli Gioielli resulting from such improper use will not be covered by the warranty.
